Terms and conditions

Please find below the terms and conditions relating to bookings made with Speak Srl (hereinafter referred to as "Speak").

1. Bookings

1.1 We advise you to make your booking for a Speak Teens Summer Camp 2024 (hereinafter referred to as the "Programme") as soon as possible, as the number of places is limited.

1.2. If you are interested in booking a place, you will need to fill in the online booking form in order to purchase a place on one of our Programmes. After completing the registration online, we will send you a confirmation email with a pre-filled Booking Form together with the Terms and Conditions of the Speak Teens Summer Camp. Having completed and signed the Booking Form with Terms and Conditions and Privacy Information document, they will need sending to us at teens@speakinitaly.com or sent by post to our office: Speak Srl, Viale Pio XI, 11 / a, 70056, Molfetta (BA), Italy.

Once we have received your signed Booking Form, we will send you a Confirmation Email and invoice along with instructions for making payments and our bank details. Your booking will be accepted and, therefore, a contract entered in to, once you have received our Confirmation Email.

1.3. The contract will be valid and effective until the end of the chosen Programme, unless previously cancelled according to the terms outlined in the Terms and Conditions.

1.4. The contract will be subject to the Terms and Conditions clearly reported together with the Booking Form in line with those listed here.

1.5. We advise you to complete the Booking Form carefully, as the data inserted will constitute the data forming the contract between you and Speak.

2. Transportation

2.1. Each Programme participant is required to independently reach, at their own expense, the Speak Teens location chosen (hereinafter referred to as the "Location").

2.2. Speak Srl offers all participants the possibility of booking our private transport service from the meeting point at the "Welcome Club" (Hotel Amadeus - Bologna) to the Location on the first day and from the Location to the "Welcome Club" (Hotel Amadeus - Bologna) on the last day. This service, which must be selected at the time of booking, is provided at a cost of € 90 one way. It is not possible to organise transport from or to other cities or locations other than that specified for the Programme.

2.3. Speak cannot be held financially responsible for the cost or organization of other transport arrangements, nor can it make reservations on behalf of participants.

2.4. We advise you to wait for our Booking Confirmation email before proceeding to book any transport necessary for reaching the Location or the "Welcome Club" (Hotel Amadeus - Bologna).

3. Costs, services and Programme payment

3.1. Cost

The total cost of the 8-day Camp (7 nights) is € 1,950.00 (VAT exempt pursuant to Article 10, paragraph 20, of Presidential Decree 633/72) and covers the following services:

a) The Speak Teens Summer Camp Programme offered by Speak and all of the activities included in it;

b) Accommodation and full board in multiple rooms with private bathroom for seven nights. Full board includes breakfast, lunch and dinner at the Location. Full board begins from dinner on the first day of the Programme and ends with breakfast on the last day of the Programme;

c) One full-day excursion during the Programme;

d) Insurance coverage for civil liability (as described in the point 10.1 below);

e) All Programme enrolment and administrative costs;

f) All Programme materials.

3.3 Once we have received your signed Booking Form, we will send you a Booking Confirmation email and invoice. For each payment you make, you must note the name of the participant, the Order Number and the Camp Code. The Order number and the Camp Code will be indicated in the confirmation e-mail and invoice.

3.4. The cost is expressed in Euros. Payments must be made by bank transfer. The details of the account to which payments should be made are provided with the invoice attached to the Booking Confirmation email. Any commission or charges associated with bank transfers and/or other costs incurred in making the transaction are the responsibility of the purchaser.

3.5. Confirmation of booking for either Camp involves the payment of a deposit of € 700 for which must be paid within 7 days of receipt of the relative invoice. After receiving the deposit payment, we will send you confirmation of payment by e-mail.

3.6. The balance must be paid no later than 30 days before the start of the Programme. We remind you not to pay the balance before receiving the invoice. For bookings made within the 40 days prior to the start of the Programme, payment must be made in full within 7 days of receipt of the relevant invoice and no later than the Programme start date. After receiving payment of either the balance or the entire course we will send you payment confirmation by e-mail.

3.7. We remind you not to make any payments before having received the relative invoice, the Order Number and your Booking Confirmation email.

3.8. If payments are not made in accordance with these Terms and Conditions, Speak will not authorize participation in the Programme.

4. Cancellation

4.1. All cancellations must be received in writing and will be effective from the moment they are received by Speak. All payments will be fully refunded in the case of cancellation no later than 30 days before the start of the Programme, excluding the deposit (see 3.5). Cancellations made less than 30 days before the start of the chosen Programme will not be eligible for any kind of refund.

4.2. No refunds (either in whole or in part) are made for those either starting the Programme late or finishing the Programme early.

4.3. Speak reserves the right to cancel the Programme if an event beyond its control prevents it from organising it. In this case participants may choose to participate in another Speak Programme or, alternatively, may be reimbursed for deposit or balance payments already made to Speak.

4.4. In no case will Speak reimburse travel expenses incurred by participants.

4.5. Speak Srl recommends taking out trip cancellation insurance with a third party travel insurance provider.

5. Refunds

5.1. Should you, in accordance with these Terms and Conditions, be entitled to a refund, it will be paid in Euros by bank transfer.

6. Rules of good conduct, responsibility of the child and early termination of the Programme

6.1. We know that participants on the Speak Programme will enjoy an unforgettable experience and rapidly improve their language skills. The intent of our Programme is to offer a positive and fun experience. To ensure that all participants feel welcome and at ease, we require all participants to comply with the Rules of Conduct set out in paragraph 16 of these Terms and Conditions.

6.2. The signatory of the booking is responsible for any damage caused by the conduct of the participant during the period of the Programme and is required to release Speak from any and all liability for the damaging actions or responsibilities of the participant and is obliged, through signing the Terms and Conditions of the Booking Form, to compensate any damage caused to Speak, and/or its personnel and/or to the location and/or to third parties by any fact, action or damage arising from the poor behaviour of the participant.

6.3. The Programme may be terminated early for one of the following reasons:

- in the event of a serious violation of the Rules of Conduct indicated at the end of these Terms and Conditions;

- In the case of behaviour deemed, at the sole discretion of Speak, inadequate, inappropriate or offensive towards others on the Programme, Speak staff or the location or that, at the sole discretion of Speak, could endanger the participant and/or others or risks causing damage to Speak and/or to the Programme location;

- For reasons of poor health of the participant.

6.4. In the event of early termination of the Programme, the signatory of the Terms and Conditions on the Booking Form will personally oversee the withdrawal of the child from the Programme and will not be entitled to any form of reimbursement for any costs incurred.

7. Promotional material

7.1. During the Programme, Speak may take photographs and/or shoot video footage that may be used by Speak as advertising material and on Social media channels. These materials can also be sent to participants upon request. By signing these Terms and Conditions, the signatory expressly authorizes Speak, in accordance with the regulations as set out by Royal Decree no. 633/1941, Legislative Decree no. 196/2003 and the relevant provisions of the Civil Code, to use such photographs and/or video in which the child is portrayed. If you do not wish that the child appear in the photographs and/or videos, you must notify Speak in writing before the beginning of the Programme.

7.2. Speak reserves the right to use feedback received, whether by letter, email or in the feedback session at the end of the Programme in future advertising campaigns or promotional materials, unless otherwise specified by the signatory.

8. Visitors

8.1. Visits by parents, family members and/or other persons during the Programme are not permitted as this would disturb the environment required for effective full immersion.

9. Responsibility for the participant during the Programme

9.1. During the course of the Programme, the participant will be under the responsibility of Speak staff and will respond to Speak staff. The participant may only leave the Programme Location during activities organized by Speak and, in any case, only when accompanied by Speak staff.

10. Insurance

10.1. Speak, in collaboration with Unipol Sai Assicurazioni, covers all participants with a civil liability insurance policy for the entire duration of the Programme. Participants will automatically be covered by the policy from the first day to the last day of the Programme, unless the signatory of these Terms and Conditions notifies Speak in writing of their preference to opt-out of the policy.

11. Changes to the Programme

11.1. The Programme has been published in good faith. Speak reserves the right to make changes or modifications to certain aspects of the Programme, for example in the event of adverse weather conditions or other factors beyond its control.

12. Processing of personal data

12.1. Notwithstanding all of the provisions of the Speak privacy policy, Speak will use the personal data provided by you for:

- Processing bookings;

- Processing Programme payments;

- Performing any other operation concerning the organization of the Programme;

- Informing you of the presence of similar products or services offered by Speak, respecting the right of users to request, at any moment, the interruption of the processing of personal data for this purpose.

12.2. Speak will not share personal data supplied by you with third parties, with the exception of those indicated in the privacy policy pursuant to Art. 13 of Legislative Decree no. 196/2003 on the processing of data.

13. Complaints

13.1. In the case of complaints regarding any aspect of the Programme, please contact Speak by writing to admin@speakinitaly.com.

14. Trinity certification

14.1. Speak reserves the right to activate the exam session upon reaching a minimum number of eight candidates. For further information please see the Speak Trinity Statement (attached with the Booking Form for those participants wishing to take the exam as expressed in the online Booking Form).

15. Validity and effectiveness of the contract, applicable law and competent court

15.1. Each of the clauses of these Terms and Conditions are independently valid of each other. In the case of the invalidity of an individual clause, the remaining clauses will remain fully valid and effective.

15.2. The contract between the signatory and Speak as well as anything not expressly provided for in the contract itself or any controversy arising from it is governed by Italian law.

15.3. Any disputes arising and/or in any case connected to the interpretation and/or application and/or execution of the contract will be subject to Italian jurisdiction and, in particular, the competence of the Court of Bari.

16. Rules of Conduct for Speak Programme participants

Speak recognizes that it has a priority duty to protect minors who attend its programmes and who are entrusted to them. Speak takes this responsibility very seriously and aims to provide an inclusive environment in which every child feels comfortable, valued, respected and listened to. Speak operates in accordance with policies established by Italian law, as well as adhering to the 1989 International Convention on the Rights of the Child (UNCRC).

An individual who has not reached the age of 18 is a “minor”, regardless of the age at which the individual is considered an adult in the country in which he resides or comes from.

Policy inspired by this priority duty to protect minors is applicable to all members of Speak staff, including anyone who works for Speak as an employee, anyone who collaborates in any way with Speak, with or without remuneration, full-time or part-time.

In accordance with this policy, Speak:

- Values, respects and listen to minors;

- Ensures that all due checks have been carried out at the time of training staff;

- Adopts systems and procedures for Speak staff aimed at the protection of minors;

- Provides a shared policy on the protection of minors and ensures that it is followed by personnel, both when planning and carrying out activities;

- Does not tolerate bullying of any kind (physical or psychological).

 

Each participant must understand and agree to abide by the following rules of behaviour:

- Each participant must strictly follow the indications of the Speak staff.

- Participants must respect established times and participate in all Programme activities with a constructive and proactive attitude, contributing to creating a positive atmosphere within the group for the duration of the shared experience.

- The consumption of alcohol and the use of drugs is strictly prohibited during the entire Programme.

- Driving of a motor vehicle is strictly prohibited during the entire Programme.

- Smoking is strictly prohibited during the entire Programme.

- Each participant must respect the Location where the Programme takes place and is aware that any damage will have to be reimbursed at the expense of their parent/guardian.

- Each participant must comply with Italian laws and the rules of the Location where the Programme takes place.

- In order that the Programme be enjoyed to the full, participants must always behave in an appropriate, respectful and polite manner.

Those who do not comply with these Rules of Conduct may be excluded from the Programme at the discretion of Speak staff, who will immediately contact the parent/guardian of the participant as the legally responsible adult in order that they remove the participant in question at their own expense.
