Benvenuto in Speak Teens Society! (ITA)
Speak Teens Society by Speak Srl (“Speak”) connects teens who want to learn English and have fun with native speakers from around the world (“Anglos”) through real-time video activity sessions in English (“sessions”). These Terms and Conditions (“Terms and Conditions”) apply to Anglos who engage with Learners (“Learners”) in Speak Teens Society sessions, through third-party online communication platforms (“platform”).
These Terms and Conditions contain the entire understanding between the parties and supersede, replace and take precedence over any prior understanding or oral or written agreement between the parties with respect to the subject matter of these Terms and Conditions.
Please review the following Terms and Conditions carefully and in their entirety.
Speak Teens Society by Speak Srl ("Speak") collega ragazzi che vogliono imparare l'inglese e divertirsi con madrelingua da tutto il mondo ("Anglos") attraverso sessioni di attività in tempo reale in inglese online ("sessioni"). Questi Termini e Condizioni ("Termini e Condizioni") si applicano agli Anglos che interagiscono con i ragazzi italiani ("Learner") per sessioni di Speak Teens Society, attraverso piattaforme di comunicazione online di terze parti ("Piattaforma").
Questi Termini e Condizioni contengono l'accordo tra le parti, sostituiscono e prevalgono su qualsiasi precedente intesa o accordo scritto o orale tra le parti rispetto all'oggetto di questi Termini e Condizioni.
Si prega di leggere attentamente i seguenti Termini e Condizioni nella loro interezza.
1.1 You must register as an Anglo with Speak Teens Society on our website by filling in the application form.
1.2 When signing up as an Anglo, you will be asked to accept and, therefore, be bound by, these Terms and Conditions of Speak Teens Society for Anglos. By clicking on “I agree” to the “Terms and Conditions and privacy policy” on our online application form, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and all of their provisions. If you do not agree to all of the Terms and Conditions, do not click “accept”.
1.3 When you register as an Anglo, you must: a) provide accurate, truthful and complete information; b) agree to promptly update Speak with any new information that may affect the operation of your account; c) authorise Speak to make any inquiries we consider necessary or appropriate to verify your information or the information you provide to us related to any services you provide via the platform.
1.4 Anglos are responsible for safeguarding and maintaining the confidentiality of their information. They agree not to disclose any Speak Teens Society account information to any third party and that they are entirely and solely responsible for any and all activities or actions that occur pursuant to the use of your Speak Teens Society account on the platform for the purposes of conducting sessions with Speak.
1.5 Anglos agree that they will not permit, enable, introduce or facilitate other persons to participate in providing sessions from your Speak Teens Society account, including others who may be subject to Terms and Conditions which are the same or similar to these Terms and Conditions. Anglos will not use false identities or impersonate any other person or use another account that you are not authorised to use.

1.4 L'Anglo è responsabile della salvaguardia e del mantenimento della riservatezza delle informazioni. Accetta di non divulgare le informazioni del proprio account Speak Teens Society a terze parti e di essere interamente e unicamente responsabile di tutte le attività o azioni che si verificano a seguito dell'uso del proprio account Speak Teens Society sulla piattaforma allo scopo di condurre sessioni con Speak.
1.5 L'utente accetta di non consentire, abilitare, introdurre o facilitare altre persone a partecipare alla fornitura di sessioni dal proprio account, compresi altri che potrebbero essere soggetti a Termini e condizioni che sono uguali o simili a questi Termini e Condizioni. Gli Anglos non useranno false identità o impersoneranno altre persone o utilizzeranno un altro account che non sono autorizzati a utilizzare.
2.1 Anglos will utilise platform time solely to participate in activity sessions in English within the scope of the Speak Teens Society Anglos are not to transact business, incur obligations, sell goods, receive payments, solicit goods or services, enter into any contract, or assign or create any obligation of any kind, express or implied, on behalf of Speak or to bind in any way whatsoever, or to make any promise, warranty, or representation on behalf of Speak regarding any matter, except as expressly authorised in these Terms and Conditions or in other communication signed by Speak. Anglos shall not use Speak’s trade names, logos, trademarks, service names, or any other proprietary designations without the prior written approval of Speak.
2.1 Gli Anglos utilizzeranno il tempo della piattaforma esclusivamente per participare a sessioni in lingua inglese nell'ambito del programma didattico Speak Teens Society. Gli Anglos non devono concludere affari, assumere obblighi, vendere beni, ricevere pagamenti, procurare ordini di beni o servizi, stipulare contratti, assegnare o creare alcun obbligo di qualsiasi tipo, esplicito o implicito, per conto di Speak o vincolare in alcun modo, o fare qualsiasi promessa, garanzia o rappresentanza per conto di Speak in merito a qualsiasi questione, ad eccezione di quanto espressamente autorizzato nei presenti Termini e condizioni o in altre comunicazioni firmate da Speak. Gli Anglos non devono utilizzare i nomi commerciali, i loghi, i marchi, i nomi dei servizi di Speak o altri materiali proprietari senza la previa autorizzazione scritta di Speak.
3.1 Speak Teens Society allows you to engage in English language activity sessions as an Anglo and, therefore, you confirm that you are a mother-tongue speaker of English.
3.2 Anglos will be guided by materials produced by Speak which are designed to facilitate the session and help Learners to improve.
3.3 Anglos agree to take reasonable precautions in all interactions with users of the platform and agree to be polite, encouraging, exercise caution, discretion, common sense and judgment in using the platform, conducting sessions and disclosing information, including any personal information, to other users.
3.4 You specifically agree not to record, copy, redistribute, broadcast, publicly perform, publicly display or disclose any contents of the session which remain private conversations, including the data and personal information of other participants at any time.
3.5 You will not use the platform or engage in sessions in any manner that may harass, embarrass or compromise the trust of another user of the platform or another Anglo or could otherwise interfere with any other party's use or enjoyment of the platform. You will respect the privacy of users of the platform and will not use the platform for unwelcome, rude or abusive communications or in any other disrespectful or detrimental manner, as determined by Speak at its sole discretion.
3.1 Speak Teens Society ti consente di partecipare a sessioni video di attività in qualità di Anglo e, pertanto, confermi di essere un madrelingua inglese.
3.2 Gli Anglos saranno guidati dai materiali prodotti da Speak . I materiali sono progettati per facilitare lo svolgimento delle sessione e aiutare i Learners a migliorare.
3.3 Gli Anglos si impegnano a prendere adeguate precauzioni in tutte le interazioni con gli utenti della piattaforma e accettano di essere educati, incoraggianti, prestando attenzione, discrezione, buon senso e giudizio nell'uso della piattaforma, nello svolgimento delle sessioni e nella divulgazione di informazioni, incluse informazioni personali, ad altri utenti.
3.4 L'utente accetta espressamente di non registrare, copiare, ridistribuire, trasmettere, mostrare pubblicamente, visualizzare pubblicamente o divulgare qualsiasi contenuto della sessione che rimane una conversazione privata; inclusi i dati e le informazioni personali di altri partecipanti in qualsiasi momento.
3.5 L'utente non utilizzerà la piattaforma per svolgere sessioni che possano in alcun modo molestare, mettere in imbarazzo o compromettere la fiducia di un altro utente della piattaforma o di un altro Anglo o interferire in altro modo con l'uso o il godimento della piattaforma da parte di terzi. Rispetterà la privacy degli utenti della piattaforma e non la userà per comunicazioni indesiderate, maleducate o offensive o in qualsiasi altro modo irrispettose o dannose, come determinato da Speak a sua esclusiva discrezione.
4.1 Anglos must use a desktop or laptop computer for sessions. Tablets or other mobile devices are not considered suitable for participation in sessions.
4.2 Before beginning sessions, you are required to properly install the third-party platform on your computer. Anglos are solely responsible for their use of third-party platforms and any terms and conditions which govern their use, entirely separate from these Terms and Conditions.
4.3 Broadband internet access, ideally with an ethernet cable, is required to ensure the quality of audio and video. The minimum connection speed requirement for conducting sessions is 10Mbps (in upload/download). If you are unsure of your connection speed, please verify prior to sessions by using an online tool such as https://speedof.me/
4.1 Gli Anglos devono utilizzare un computer fisso o un portatile per le sessioni. I tablet o altri dispositivi mobili non saranno ritenuti idonei allo svolgimento delle sessioni.
4.2 Prima di iniziare le sessioni, è necessario installare correttamente la piattaforma di terze parti sul computer. Gli Anglos sono gli unici responsabili del proprio utilizzo di piattaforme di terze parti e di tutti i termini e condizioni che regolano il loro utilizzo, completamente separati da questi Termini e Condizioni.
4.3 Per garantire la qualità dell'audio e del video è necessario l'accesso a Internet a banda larga, idealmente con un cavo Ethernet. Il requisito di velocità minima di connessione per lo svolgimento delle sessioni è 10 Mbps (in upload / download). 5.1 Should an Anglo need to cancel a scheduled session, they should try to give at least 24 hours’ notice.
5.2 Anglos must give notice of cancellation of a session by email by writing to teenanglos@speakinitaly.com

6.1 Speak may use a range of recognised online third-party platforms for sessions. These include but may not be limited to: Zoom, Google Meet/Hangouts, Cisco Webex and similar.
6.2 You acknowledge and recognise that Speak does not specifically endorse any of the platforms used and Speak will therefore not be liable for any incidental or consequential damages, including loss of data, privacy, service interruption, viruses and hacked accounts, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of your use of the platform or your engagement in sessions, or from any communications, interactions or meetings with users of the platform or other persons with whom you communicate or interact as a result of your use of the platform.
6.3 Anglos take full responsibility for any other technical process or actions carried out online beyond the scope of sessions and agree not to share files with Learners other than those specifically provided by Speak. Anglos agree that they will not under any circumstances share anything illegal or send unwanted spam including, although not limited to, unwanted or unsolicited pictures, gifs, emojis or files, share inappropriate content or material (involving, for example, nudity, pornography, offensive language, graphic violence, or criminal activity), engage in activity that is harmful to you or others (e.g. transmitting viruses).
6.4 Anglos agree that they will not under any circumstances infringe upon the intellectual or creative rights of others (e.g., unauthorised sharing of copyrighted materials, music, video, photographs or other copyrighted materials).
6.1 Speak può utilizzare una serie di piattaforme online di terze parti per lo svolgimento delle sessioni. Queste includono ma non possono essere limitate a: Zoom, Google Meet / Hangouts, Cisco Webex e simili.
6.2 L'utente prende atto e riconosce che Speak non approva specificamente nessuna delle piattaforme utilizzate e pertanto Speak non sarà responsabile per eventuali danni accidentali o consequenziali, inclusi perdita di dati, privacy, interruzione del servizio, virus e account compromessi, danni al computer o guasti del sistema o il costo di prodotti o servizi sostitutivi, o di eventuali danni per lesioni personali o corporee o disagi emotivi derivanti dall'uso della piattaforma o dalla partecipazione in sessioni o da qualsiasi comunicazione, interazione o incontro con gli utenti della piattaforma o altre persone con le quali comunichi o interagisci a seguito dell'utilizzo della piattaforma.
6.3 Gli Anglos si assumono la piena responsabilità per qualsiasi altro processo tecnico o azione eseguita online oltre lo scopo delle sessioni e si impegnano a non condividere file con Learners diversi da quelli specificatamente forniti da Speak. Gli Anglos concordano sul fatto che in nessun caso condivideranno nulla di illegale o invieranno spam indesiderato tra cui, anche se non limitato a, immagini, gif, emoji o file indesiderati o non richiesti, condividendo contenuti o materiale inappropriato (che coinvolge, ad esempio, nudità, pornografia, offensiva linguaggio, violenza grafica o attività criminale), intraprendendo attività dannose per loro o per altri (ad esempio la trasmissione di virus).
6.4 Gli Anglos concordano sul fatto che non violeranno in alcun caso i diritti intellettuali o creativi di altri (ad es. Condivisione non autorizzata di materiali protetti da copyright, musica, video, fotografie o altri materiali protetti da copyright).
7.1 The didactic materials, content, information, graphics, design, and all other conceptual elements of Speak Teens Society are protected by all relevant intellectual property and proprietary rights and applicable laws. All Speak materials are the property of Speak Srl. All trademarks, service marks, and trade names are proprietary to Speak Srl. Unless expressly authorised by Speak, you agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorised use of the Speak materials.
7.1 I materiali didattici, i contenuti, le informazioni, la grafica, il design e tutti gli altri elementi concettuali di Speak Teens Society sono protetti da diritti di proprietà intellettuale e di proprietà riservata e dalle leggi applicabili. Tutti i materiali di Speak sono di proprietà di Speak Srl. Tutti i trademarks, i marchi di servizio e i nomi commerciali sono di proprietà di Speak Srl. Se non espressamente autorizzato da Speak, l'utente accetta di non vendere, concedere in licenza, distribuire, copiare, modificare, mostrare pubblicamente o visualizzare, trasmettere, pubblicare, cambiare, adattare, creare opere derivate o utilizzare in altro modo il materiale Speak.
8.1 Notwithstanding all of the provisions of the separate Privacy Policy (available in full at www.speakinitaly.com/anglos/teens/privacy-policy), Speak has informed me that personal data will be used in order to:
a) Process Speak Teen Society Anglo applications;
b) Perform other necessary operations concerning the organisation of sessions;
c) Inform you of the existence of similar products or services offered by Speak, subject to my right to, at any time, request the interruption of the processing of personal data for this purpose.
8.2 Speak has informed me that it will not share my personal data with third parties, with the exception of those indicated in the Privacy Policy referred to above.8.1 Nonostante tutte le disposizioni dell'Informativa sulla privacy separata (disponibile per intero su www.speakinitaly.com/anglos/teens/privacy-policy), Speak mi ha informato che i miei dati personali verranno utilizzati per per:

9.1 Any disputes and complaints must be addressed to Speak Srl by writing to teenanglos@speakinitaly.com.
9.2 Speak will, within the scope of the law, attempt to resolve all disputes in a satisfactory manner for all parties involved.

10.1 The Speak Teens Society course programme has been published in good faith. Speak Srl reserves the right to make changes or modifications to any aspect of the course in the case of factors beyond its control.
10.2 Speak reserves the right to change these Terms and Conditions at any time. In the event that any changes are made, the revised terms and conditions shall be posted on this website immediately and users shall be notified with an email sent to the address provided at the time of application.
10.1 Il Programma del corso Speak Teens Society è stato pubblicato in buona fede. Speak Srl si riserva il diritto di apportare dei cambiamenti o delle modifiche ad alcuni aspetti del Programma, nel caso di fattori che esulano dal proprio controllo.
10.2 Speak si riserva il diritto di modificare questi Termini e Condizioni in qualsiasi momento. Nel caso in cui vengano apportate modifiche, i Termini e Condizioni modificati saranno immediatamente pubblicati su questa pagina Web e le parti coinvolte saranno avvisate con un'e-mail inviata all'indirizzo fornito al momento dell'attivazione dell'account.
11.1 Anglos will comply with all applicable local, provincial, and national laws, treatises and regulations in connection with your provision of sessions.
11.2 Anglos acknowledge and fully understand that Italian law governs the present Terms and Conditions and any dispute arising from it as well as being the applicable jurisdiction for anything not expressly covered by the agreement. Any disputes arising and/or connected with the interpretation and/or application and/or execution of these Terms and Conditions shall thus fall under the jurisdiction of the Italian judicial authorities and, specifically, the Court of Bari.
11.1 Gli Anglos sono tenuti a rispettare tutte le leggi, i trattati e le normative locali, provinciali e nazionali applicabili in relazione alla fornitura di sessioni.
11.2 Gli Anglos riconoscono e comprendono pienamente che la legge italiana regola i presenti Termini e condizioni e qualsiasi controversia che ne derivi, nonché la giurisdizione applicabile per qualsiasi cosa non espressamente coperta dall'accordo. Qualsiasi controversia derivante e / o connessa con l'interpretazione e / o l'applicazione e / o l'esecuzione di questi Termini e Condizioni rientrerà quindi nella giurisdizione delle autorità giudiziarie italiane e, in particolare, del Tribunale di Bari.
